Agreement to terms of services provided

All services will be provided by an agent of Frank’s Aquatic Specialists unless otherwise specified and agreed to by all parties involved.  

Training will be tailored to suit the needs of the student.  Some students will display what they have learned faster than others.  Be patient knowing all students are learning and will use the acquired skills when they are ready.  

During practice without an instructor, please do not force a swimmer past their level of instruction.  This can cause stress and slow the instruction process.  Reasonable amounts of development will be evident with practice and all improvement should be shared with instructors to ensure the proper progression of instruction.

For participant protection, the training environment will be reasonably maintained to be free from injury causing hazards.  This includes, but is not limited to: Debris cleared from deck and water, pets should be off the deck, ladders and rails should be secure, tiles repaired, cracks maintained.  Water temperature should be maintained for student’s comfort.  Recommended temperature varies by training activity.  Chemical levels should be consistent with government ordinances.

A parent or guardian must be in attendance for all training sessions unless otherwise specified and agreed to in writing by all parties involved.

Parents, guardians and event hosts are ultimately responsible for the safety of everyone in attendance.  Agents of Frank’s Aquatic Specialists will act in accordance to their training and provide due diligence in reducing risk to all in attendance.  Liability release sheets are available for pool parties.  Parents should sign their name near the child’s name and they should be signed out at the end of the event.  

Unless otherwise specified, Agents of Frank’s Aquatic Specialists will enforce the following basic safety rules:

1 Walk around the pool.
2 Diving and jumping are only allowed in specific areas of the pool when water depth is sufficient and it is safe to do so.
3 Glassware should be kept away from the pool area.
4 The consumption of alcohol will be prohibited (unless disclosed and allowed before the day of the event).
5 Non-swimmers will be under the direct supervision of a parent or guardian.
6 Floatation devices are only allowed for recreation purposes by swimmers unless a non-swimmer is in direct contact of a parent or guardian.
7 Activities deemed as unsafe will be stopped immediately.
8 All bathers who are considered to be potentially incontinent will wear a water safe swim diaper to prevent fecal contamination and facility closure.

All contracting and billing will be done through Frank’s Aquatic Specialists in accordance to the terms outlined by each contract.

Payment for all services will be made to Frank’s Aquatic Specialists, payment to instructors and guards will be made by Frank’s Aquatic Specialists who is responsible for tax reporting.  Any attempts to renegotiate a contract should be reported to Frank’s Aquatic Specialists.  

Schedule conflicts can be rescheduled with two days notice or by Thursday of any weekend services.  Without proper cancellation service fees will be billed in accordance to the services ordered.  

Gift certificates have no expiration date and can only be redeemed for merchandise or services provided by an agent of Frank’s Aquatic Specialists.

Violation of the above terms may result in a forfeiture of all fees associated with the services ordered without services being fully performed.  


Understanding of risk and release of liability

I, the registered participant or custodial parent or legal guardian of the registered student/participant (if a minor), understand there are potential risks associated with, yet not specifically the result of, all activities including voluntary aquatic activity.  Potential risks include but are not limited to heat injury, cold injury, paralysis, chemical exposure, water and air borne illness, sinus infection, respiratory complications, cardiac complications, and hair and skin conditions.  These potential risks can lead to minor or permanent injury or death.  With this in mind, I accept ultimate responsibility for any and all injury or death resulting from my participation, including the participation of all others entrusted to me by written, oral or implied consent, in this program.  I HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS from all liability, claims, demands, causes of action, charges, expenses and attorney fees (Including attorney fees to establish any and all rights to indemnity or incurred on appeal).   I release liability and will hold blameless Frank’s Aquatic Specialists, its owners, board of directors, facilities and their owners, instructors, lifeguards, management, volunteers, interns, advertisers and all related parties or stakeholders for any and all injuries or deaths associated with the fulfillment of the services provided by any of the above named regardless of fault, acts of nature, negligence or apparent wrongdoing.
